1. General information

This Privacy Policy sets out how we process and protect the personal data of visitors to the website evenema.com and its subdomains, including the knowledge base at wiedza.evenema.com (jointly referred to as the "Website"), as well as of persons who contact us through those services. Individual provisions of this Policy may apply to selected services only, which is indicated in their wording.

We respect the privacy of the Website's users and process personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and with applicable Polish law.

3. Scope of data collected

Through the Website we may collect the following data:

  • data provided voluntarily in correspondence: name and surname, e-mail address, telephone number, company name and any other information included in the message (contact form or direct e-mail),

  • data collected automatically: IP address, browser type, device type, operating system, approximate location and information on how the Website is used (cookies and similar technologies).

Providing data is voluntary, but necessary in order for us to reply to a message or prepare an offer.

4. Purposes and legal bases of processing

We process personal data for the following purposes:

  • replying to an enquiry sent through the contact form or by e-mail: Article 6(1)(f) GDPR (legitimate interests of the controller, namely conducting correspondence),

  • preparing and presenting an offer and taking steps prior to entering into a contract: Article 6(1)(b) GDPR,

  • performing a concluded contract: Article 6(1)(b) GDPR,

  • complying with legal obligations, including tax and accounting obligations: Article 6(1)(c) GDPR,

  • establishing, pursuing or defending claims: Article 6(1)(f) GDPR,

  • analysing visit statistics and improving the Website: Article 6(1)(f) GDPR, or the user's consent (Article 6(1)(a) GDPR) with respect to cookies,

  • marketing our own services, including remarketing by means of the Meta Pixel: the user's consent (Article 6(1)(a) GDPR) given through cookie settings,

  • presenting materials from the campaigns we deliver in the form in which they were produced, including video materials embedded from YouTube in the knowledge base at wiedza.evenema.com: Article 6(1)(f) GDPR (see the section "Embedded video materials from YouTube").

5. Recipients of data

Personal data may be disclosed to entities whose services we use in operating the Website and running our business, solely to the extent necessary to achieve the purposes described above:

  • Framer B.V. (the Netherlands): provider of the platform on which the Website runs (hosting),

  • Meta Platforms Ireland Limited (Ireland): provider of the Meta Pixel, used with the user's consent for remarketing and for measuring the effectiveness of advertising on Facebook and Instagram; Meta also processes this data for its own purposes as a separate controller, see Meta's privacy policy (facebook.com/privacy/policy),

  • Google Ireland Limited (Ireland): provider of the YouTube service, from which we embed video materials in the knowledge base at wiedza.evenema.com; Google also processes this data for its own purposes as a separate controller, see Google's privacy policy (policies.google.com/privacy),

  • providers of e-mail services and office tools,

  • providers of analytics tools (where used, see the section "Cookies"),

  • entities providing accounting, legal or IT services,

  • public authorities, solely where required by law.

We do not sell personal data and we do not share it with third parties for marketing purposes.

6. Transfers of data outside the European Economic Area

In connection with the use of services provided by certain suppliers (for example Meta Platforms, Google, analytics tools or hosting infrastructure), data may be transferred to countries outside the EEA, including the United States. Any such transfer takes place on the basis of mechanisms provided for in the GDPR, in particular European Commission adequacy decisions (such as the EU-US Data Privacy Framework) or standard contractual clauses.

7. Data retention periods

We retain personal data as follows:

  • correspondence and requests for offers: for the duration of the correspondence and then for up to 3 years for the purposes of possible claims,

  • data relating to the performance of a contract: for the term of the contract and then for the period required by law (including tax law, as a rule 5 years from the end of the tax year),

  • analytics data and cookies: for the periods indicated in the section "Cookies" or until consent is withdrawn.

8. Rights of data subjects

Every person whose data we process has the right to:

  • access their data and obtain a copy of it,

  • rectify (correct) their data,

  • erase their data,

  • restrict processing,

  • data portability,

  • object to processing based on legitimate interests,

  • withdraw consent at any time, without affecting the lawfulness of processing carried out before its withdrawal,

  • lodge a complaint with the supervisory authority, the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warsaw, Poland, uodo.gov.pl).

9. Cookies

The Website uses cookies, that is small text files stored on the user's device. We use:

  • necessary cookies: ensuring the correct operation of the Website (basis: legitimate interests of the controller); their use does not require consent,

  • analytical and statistical cookies: allowing us to analyse how the Website is used (used only with the user's consent),

  • marketing cookies (Meta Pixel): allowing audiences to be created and tailored advertising to be displayed on Facebook and Instagram, and its effectiveness to be measured (used only with the user's consent); data collected by the Meta Pixel is retained by Meta in accordance with its own policy, and audiences based on activity on the Website are retained for a maximum of 180 days.

Users may change their cookie settings in their browser at any time, including blocking cookies from being stored or deleting cookies already stored. Restricting the use of cookies may affect some functions of the Website.

10. Embedded video materials from YouTube

In the knowledge base at wiedza.evenema.com we publish video materials embedded from YouTube. The player runs in privacy-enhanced mode, on the youtube-nocookie.com domain, which limits the use of data about a viewing for the personalisation of content on YouTube.

The player loads automatically together with the page on which it is placed. This means that simply displaying such a page causes a connection to be established with Google's servers and the visitor's IP address to be transmitted to them, together with technical data of the browser such as its type and version, the operating system and the address of the page from which the connection originates. This happens regardless of whether the visitor plays the material and regardless of whether they hold a Google account.

The controller of data processed in connection with the use of the YouTube service by users in the European Economic Area is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google's data processing practices are described in Google's privacy policy available at policies.google.com/privacy.

Our legal basis for this processing is the legitimate interests of the controller, namely presenting materials from the campaigns we deliver in the form in which they were produced (Article 6(1)(f) GDPR).

A visitor who does not wish a connection to Google's servers to be established may block content embedded from external services in their browser settings or by using an extension that blocks such content.

11. Data security

We apply technical and organisational measures appropriate to the nature of the data processed, including an encrypted connection (SSL/TLS), restricting access to data to authorised persons only, and working with trusted service providers.

12. Changes to the Privacy Policy

This Privacy Policy may be updated, for example in connection with changes in the law or in the scope of the services we provide. The current version is always available on the Website, together with the date of the last update.
